A 48-year-old man from Rabat was condemned to 15 months imprisonment, suspended to two years, after being found guilty of being in possession of a stolen car.
The stolen car, a Mitsubishi RBR, was found in the garage of Mario Fenech at Targa Gap, limits of Mosta. The police made the discovery while they were carrying out an eviction, on the orders of the Lands Commissioner.
The eviction order was made on 23 October 2008. The police turned up on site to carry out the eviction six days after the order was made, where they found a number of cars inside two big stores, as well as a number of animals.
Mr Fenech provided the authorities with the appropriate log books for the majority of the vehicles found, however he failed to do so for the Mitsubishi in question. He also failed to provide the registration number, and the wheels of the car had been dismantled.
From investigations, led by prosecuting Superintendent Stephen Mallia, it was found that the vehicle had been stolen on 27 October 2007 from St Julian's. It was registered under Martin Buhagiar.
Magistrate Demicoli remarked that it is still unclear as to how the stolen vehicle wound up in the possession of the accused, adding that in view of the appropriate log books of the other vehicles found, it is understood that the accused was aware that he was in possession of a stolen vehicle.
Due to Mr Fenech's relatively benign police conduct, Magistrate Demicoli sentenced him to 15 months imprisonment, suspended to two years.
