Motorist cleared of responsibility for head-on collision with bus

A court today cleared a motorist of any responsibility for a collision with a bus which left his wife and son grievously injured.

The accident took place in December 2014 on Saqqajja Hill after the motorist, Carmel Micallef, found himself in the opposite lane after losing control of his vehicle whilst driving in rainy and low visibility conditions.

Mr Micallef then collided with an oncoming bus which was driving towards Dingli. He was charged with having caused grievous injuries through negligence and slightly injuring the bus driver. He was also accused of speeding, reckless driving, driving against the direction of traffic and damaging the bus.

The court, which was presided over by Magistrate Caroline Farrugia, heard how Mr Micallef skidded into the opposite lane after poor visibility led him to brake suddenly after encountering stationary vehicles in front of his van whilst driving from Rabat to Attard.

A magisterial inquiry found that Mr Micallef lost control of the vehicle after going round a bend and discovering a line of stationary vehicles ahead of him. 

Transport Malta had withdrawn its claims in the interim and the only other witnesses were his wife and son, who had chosen not to testify.

The court, after taking the circumstances into account, concluded that Mr Micallef was not at fault as he could not have foreseen the accident and cleared him of all charges.
