An Appeals Court has confirmed a judgment awarding OPM chief of staff Keith Schembri €5,000 in libel damages following the publication of an article in In-Nazzjon in 2014.
The article carried the title "Hamsin Jum mill-Harba ta' Ryan Schembri Li Hu Mfittex Dwar il-Frodi ta' €40 Miljun - Hawn min jaf fejn qieghed" (Fifty days since the escape of Ryan Schembri, hunted by the police on €40 million fraud – Somebody knows where he is"), published on 11 November 2016.
In 2016, the court had found in favour of Schembri and fined Nathaniel Attard, then editor of In-Nazzjon, and journalist Joe Mikallef €5,000.
Attard and Mikallef appealed the judgment, but their appeal was turned down.
The court was presided by Mr Justice Anthony Ellul.
In another judgment, Mr Justice Ellul confirmed a €5,000 fine for Il-Mument editor Roderick Agius in a case submitted by former MP Franco Mercieca.
The libel case was on an article published in Il-Mument on 15 December 2013 entitled ""Franco Mercieca jisfida u jibqa' ghaddej bil-prattika privata" (Franco Mercieca continues to practice profession).
Even here, the court confirmed the original judgment made by the Magistrates Court on 24 November 2016.
