Witness claims she never saw gun in hands of Sliema jewelry-hold up suspect

An Italian witness took the stand this morning where she claimed to have never seen a gun in the hands of an Albanian suspect who was being arrested in connection with theft from a jewelry shop.

The incident took place on 13 October, when two Albanian men were approached by the police and placed under arrest in connection with a high profile robbery of a jewelry shop in Sliema that had taken place some days earlier.

One of the men, Daniel Muka, reportedly drew a firearm, pointed it at the police and pulled the trigger. No shots rang out however, as the firearm probably malfunctioned. As a result of the incident, Muka has been charged with attempted murder of three police officers, assaulting an officer and violently resisting arrest. The incident took place in Bay Street (Triq il-Bajja), St Julian's.

The first witness this morning was the Italian woman, who owns a bar right were the incident took place. She testified to having heard a police car park outside her bar, and to seeing police officers get out of the car and directly approach the suspects who were in the street. The woman said she saw Muka between two police cars surrounded by police, and that she only ever saw the gun on the roof of a car and not in anybody's hands. She continued that an employee of hers saw the whole incident. 

The employee also took the witness stand, saying that he had heard the commotion at around 11pm on the night in question. He said that he saw the accused physically fight with the police, and that he also saw the gun on the roof of a car. He claimed to have known it belonged to the accused due to the fact that he saw police place it inside a plastic evidence bag. 

The case continues on 5 December while the accused remains reprimanded in custody until then. 

Lawyer Noel Bianco is representing the accused while magistrate Yana Micallef Stafrace presided over the case.
