Courts again reject application by Simon Busuttil, David Casa

The court this morning again rejected an application by former Nationalist Party leader Simon Busuttil and PN MP David Casa, who requested an inquiry on Minister Konrad Mizzi and OPM chief of staff Keith Schembri in spite of a previous court decision denying a similar request stating "there was no basis" for one.

In a statement, the government said that the court decided that there is "no legal or judicial base" to accept the request made by Busuttil and Casa.

A decree given by the inquiring magistrate on 21 May 2018 "has no need to be given legal/judicial, autonomous or independent approval" and this is because the request made by Busuttil and Casa had been denied on 20 April 2018, and this was a final decision as it could not be appealed.

This is another court that turned down requests for an independent inquiry by Busuttil and Casa.

It follows the recent judgment by the Court of Criminal Appeal on a request by Busuttil to investigate a number of persons, including the Prime Minister, Mizzi and Schembri. "Once again, it resulted that Busuttil was coming and going to court with no evidence," the government said.
