Court confirms 2009 Malta Today article on Cachia Caruana as libellous

A Court of Appeal has confirmed that an article published in Malta Today in 2009 was libellous, as declared by the original judgment, which also ordered the newspaper's managing editor, Saviour Balzan, to pay Malta's former representative in the EU, Richard Cachia Caruana, €3,000 in damages.

The article was titled 'Why Pople will protest and not vote". Cachia Caruana took umbrage with the line that reads: "RCC acts as he always acted, secretly calling on his army of sycophants to dish out bile and hate from their blogs and columns. They incite hatred and attempt to decimate any critics".

Balzan had retracted the statement in an out-of-court settlement back in March 2016, and shortly after reinstated it.

The Court of Appeal declared that Balzan's remarks had "no objective or factual basis".
