Elderly man cannot repossess garage in spite of court ruling

A nonagenarian is unable to retake possession of a garage he rented out in late 2013 notwithstanding a court ruling in his favour and paying €1,500 in legal and administrative fees. In the circumstances, Emanuel Agius felt he had no alternative but to initiate another court case to obtain back his own property, from which he has a rental income of €450. "It is said justice is blind but, in this case, it is cross-eyed. Instead of helping my parents as rightful owners, the system is turning them into sacrificial lambs, effectively confiscating their property," his daughter, Anna Maria Baldacchino, told this paper. The saga started on October 1, 2013, when Mr Agius entered into an agreement with a businessman to rent out his garage in Rudolph Lane, Gżira for 12 months for €50 a month. The businessman wanted to use the garage as a store. Mr Agius is claiming that, after nine months, the businessman stopped paying rent and, on expiry of the rental agreement in September 2014, did not vacate the garage. Mr Agius then started legal proceedings to evict him. The landlord's requests were not challenged and, last July, the court found in his favour, instructing the businessman to vacate...
