Paqpaqli accident: No mechanical fault, driver lost control; President exonerated

The magistrate who investigated the incident which occurred on 4 October during the charity activity of Paqpaqli ghall-Istrina concluded that the accident was caused when the driver of the Porsche 918 lost control of the vehicle. There was no mechanical failure in the car, Magistrate Consuela Scerri Herrera ruled.

However, the inquiry - the results of which were presented today by Justice Minister Owen Bonnici - also points its finger towards the organisational committee, insisting that the security measures in place were not enough in the circumstances.

President Marie Louise Coleiro Preca was not involved in the organisation of the event, the inquiry found. Therefore, the President cannot be accused of what happened and has no criminal responsibility.

The 1,700 page inquiry was concluded in three months.

Those that are mentioned in the inquiry are not necessarily guilty, the inquiry said.

The inquiry also mentions a list of secondary causes. The investigation noted lack of security measures because there were no concrete barriers. Instead, the barriers put on site were for crowd control.

It also mentioned the fact that there was no safety plan, no consultation with CPD and Mater Dei Hospital, no signs for drivers and a fault in the design of the circuit itself.

The magistrate said it would not be fair to put all members of the organising committee in the same basket. A total of 11 committee members will be arraigned in court. Tonio Darmanin was heading the committee. Two members of the committee were AFM officials.

There was an arrangement so that after the inquiry, Paul Bailey, the driver, would come back to Malta voluntarily. He had been allowed to return to his home after the accident, in which 28 people were injured.
